Our pick surface technologies are protected by one or more United States patents. No license or right is granted to you by implication, estoppel, or otherwise in or under any patent, trademark, copyright, or proprietary right of Acoustik Attak, Inc. Unauthorized reproduction, modification, distribution, transmission, republication, display, or performance of the content on this site is strictly prohibited.
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. This site may contain certain historical information which is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right to limit the sales of our products to any person, geographic region or jurisdiction, and to limit quantities or discontinue any product at any time.
By subscribing to any Pik Club tier or Subscribe & Save plan, you authorize AttakPik and our subscription partner (Appstle) to charge your payment method on a recurring monthly basis at the rate indicated at the time of enrollment.
Auto-Renewal Disclosure: Your subscription will automatically renew each billing cycle at the then-current rate until you cancel. You will be charged on the same date each month (or the nearest available date). Before your first charge and before any price change, you will receive a clear confirmation of the amount, frequency, and billing date via email. This disclosure is provided in compliance with applicable auto-renewal laws, including New York General Business Law § 527 and California Business & Professions Code § 17600 et seq.
Price Changes: Subscription prices may be adjusted with at least 14 days' advance email notice before your next billing cycle. You may cancel before the new price takes effect.
Cancellation: You may cancel, pause, or skip your subscription at any time through your account dashboard or by emailing support@attakpik.com. Cancellations take effect at the end of your current billing cycle — no partial refunds are issued for the current period. Picks already shipped are yours to keep.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your account information as needed.
We may provide you with access to third-party tools over which we neither monitor nor have any control. You acknowledge that we provide access to such tools "as is" and "as available" without any warranties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites and will not have any liability for them.
If you send creative ideas, suggestions, proposals, or other materials (collectively "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are under no obligation to maintain any comments in confidence, pay compensation for any comments, or respond to any comments. You agree that your comments will not violate any right of any third-party, and will not contain unlawful, abusive, or obscene material.
Your submission of personal information through the store is governed by our Privacy Policy.
International Customers & GDPR: If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdiction with data protection laws, we process your personal data in accordance with applicable regulations including the EU General Data Protection Regulation (GDPR). We collect only the data necessary to fulfill your order, manage your account, and communicate with you. You have the right to access, correct, delete, or export your personal data at any time by emailing support@attakpik.com. We retain personal data only as long as necessary to fulfill the purposes described in our Privacy Policy or as required by law. For EU orders fulfilled through our partner Snaren Shop, their privacy policy also applies to your transaction.
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice.
You are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any international, federal, provincial or state regulations; to infringe upon intellectual property rights; to harass, abuse, insult, or discriminate; to submit false or misleading information; to upload malicious code; to collect personal information of others; to spam, phish, or scrape; for any obscene or immoral purpose; or to interfere with the security features of the Service.
We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free, or that the results obtained will be accurate or reliable. The service and all products are provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, either express or implied. In no case shall AttakPik, our directors, officers, employees, affiliates, agents, contractors, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the service or any product. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.
Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@attakpik.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If we are unable to resolve a dispute informally, any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Nassau County, New York, or at your election, may be conducted by telephone or online. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and AttakPik each waive any right to a jury trial.
Exceptions: Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
You agree to indemnify, defend and hold harmless AttakPik (Acoustik Attak, Inc.) and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, service providers, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service without affecting the validity of remaining provisions.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate at any time by ceasing to use our site. If in our sole judgment you fail to comply with any term or provision, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
These Terms of Service and any policies or operating rules posted on this site constitute the entire agreement between you and us, superseding any prior agreements, communications and proposals. Any ambiguities in interpretation shall not be construed against the drafting party.
These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of New York, United States. Except as otherwise specified in the Dispute Resolution section above, any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nassau County, New York.
We reserve the right, at our sole discretion, to update or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
